By accessing or using JD Generator (the "Service"), located at jdgenerator.co, you agree to be bound by these Terms & Conditions ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use the Service.
2. AI-Generated Content Disclaimer
JD Generator uses artificial intelligence to assist in drafting job descriptions ("Generated Content"). You acknowledge and agree that:
- Generated Content is a draft, not a final product. AI outputs are starting points that require human review, editing, and judgment before use.
- Generated Content is not legal advice. Nothing produced by the Service constitutes legal, employment, HR, or compliance advice. JD Generator is not a law firm and does not provide legal services.
- AI can make mistakes. Generated Content may contain inaccuracies, omissions, outdated information, or language that is inappropriate for your specific jurisdiction, industry, or organizational context.
- Context matters. The AI has no knowledge of your company's specific policies, culture, prior job postings, past litigation history, or local legal requirements beyond what you provide in your prompt.
3. No Guarantee of Legal Compliance
JD Generator makes no representation or warranty that any Generated Content is compliant with applicable law. Employment law varies significantly across jurisdictions, and legal requirements change frequently. Without limitation, you are solely responsible for ensuring that your job descriptions comply with:
- Equal Employment Opportunity Commission (EEOC) requirements and Title VII of the Civil Rights Act
- Americans with Disabilities Act (ADA) and similar state/local disability discrimination laws
- Age Discrimination in Employment Act (ADEA)
- Pay transparency and salary disclosure laws (e.g., Colorado EPEWA, New York City Local Law 32, California SB 1162)
- State and local ban-the-box, criminal history, and credit check laws
- Immigration and work authorization requirements
- Industry-specific licensing or certification requirements
- Any other applicable federal, state, local, or international employment laws
Laws applicable to your job postings depend on where your company is located, where the role will be performed, and where candidates may apply from. Consult qualified legal counsel for jurisdiction-specific guidance.
4. User Responsibility
You agree that you are solely responsible for:
- Reviewing, editing, and verifying all AI-generated job descriptions before publication or distribution
- Ensuring that job descriptions accurately reflect the actual requirements of the role
- Confirming that required qualifications are genuinely necessary and not used to screen out protected classes
- Verifying pay ranges for accuracy and compliance with applicable salary disclosure laws
- Any hiring decisions made using Generated Content, including their outcomes and consequences
- Any regulatory investigations, audits, or proceedings relating to your use of Generated Content
- Obtaining appropriate legal review before publishing job descriptions in jurisdictions with complex employment law requirements
JD Generator is a productivity tool. The final job description you publish is your document, your responsibility.
5. Bias Detection Disclaimer
JD Generator includes a bias detection feature that flags language that may discourage candidates from underrepresented groups from applying. You acknowledge that:
- Bias detection is a screening tool, not a legal certification. A job description that passes our bias checker has not been reviewed by a lawyer and is not guaranteed to be free from unlawful discriminatory language.
- Not all biased language is detected. Our AI may miss context-specific language that a human reviewer or employment attorney would identify as problematic.
- A passing score does not mean legal compliance. Bias-free language is one factor in compliant job postings; it is not a substitute for comprehensive legal review.
- False negatives and false positives occur. The bias checker may flag neutral language as problematic or miss genuinely problematic language.
Use the bias detection feature as one input in your review process, not as a final determination of compliance.
6. Data Usage & Privacy
What we collect
When you use JD Generator, we may collect the information you enter into the wizard (job title, role details, requirements, company context) and anonymized usage data (pages visited, features used, session duration) to improve the Service.
How we use your data
- To generate your job description. Your inputs are sent to an AI language model to produce the Generated Content.
- To improve the Service. We may use anonymized, aggregated data to identify product improvements. We do not use your specific job descriptions to train AI models without your explicit consent.
- We do not sell your data. Your inputs and Generated Content are not sold to third parties.
- We do not share identifiable information with third parties except as required by law or to provide the Service (e.g., AI model inference providers).
Data retention
Generated job descriptions may be stored temporarily to enable features like export and history. You may request deletion of your data by contacting mark@jdgenerator.co.
Third-party AI providers
JD Generator uses third-party AI inference services to generate content. By using the Service, you consent to your inputs being processed by these providers subject to their applicable terms and privacy policies. Avoid entering sensitive personal information or confidential business data into the wizard.
7. Acceptable Use
You agree not to use JD Generator to:
- Create job descriptions designed to screen out candidates based on protected characteristics (race, color, religion, sex, national origin, age, disability, genetic information, or any other protected class)
- Generate content intended to deceive applicants about the nature of a role, compensation, or working conditions
- Produce materials for any illegal hiring practice, including discriminatory testing, pre-employment inquiries prohibited by law, or requiring medical information before a conditional offer
- Systematically scrape, crawl, or extract content from the Service by automated means
- Attempt to reverse-engineer, decompile, or extract the underlying AI models or prompting systems
- Use the Service in any manner that violates applicable law
We reserve the right to terminate access for violations of these restrictions.
8. Intellectual Property
Your Generated Content
Job descriptions you generate using JD Generator belong to you. We do not claim ownership over the text produced by the AI using your inputs. You are free to edit, publish, distribute, and use your Generated Content for any lawful purpose.
The Service
The JD Generator platform, including its software, design, algorithms, prompting systems, and branding, is owned by JD Generator and protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Service without our express written permission.
Your inputs
You retain ownership of the information you provide as inputs. By using the Service, you grant JD Generator a limited, non-exclusive license to process your inputs solely for the purpose of providing and improving the Service.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- JD Generator and its operators are not liable for any hiring outcomes arising from use of Generated Content, including but not limited to: failure to hire qualified candidates, discrimination claims, regulatory enforcement actions, or litigation costs.
- JD Generator is not liable for any violations of employment law, labor regulations, EEOC requirements, ADA requirements, pay transparency laws, or any other legal requirements arising from job descriptions produced using the Service.
- JD Generator is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service, including damages resulting from inaccuracies in Generated Content.
In no event shall JD Generator's total liability to you for all claims arising out of or related to these Terms or your use of the Service exceed the greater of (a) the total amount you paid for the Service in the twelve months preceding the claim, or (b) one hundred dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless JD Generator and its operators, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use or misuse of the Service
- Any job description you publish or distribute using Generated Content
- Your violation of these Terms
- Your violation of any applicable law or regulation, including employment and anti-discrimination laws
- Any discrimination claim, regulatory investigation, or enforcement action arising from your hiring practices
- Any third-party claim arising from your use of Generated Content
11. Account Terms
If you create an account with JD Generator:
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorized use of your account
- You must provide accurate information when creating or updating your account
- You may not share your account with others or create accounts on behalf of third parties without authorization
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or whose use of the Service poses legal or reputational risk.
12. Modifications & Termination
Changes to Terms
We may update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you disagree with material changes, stop using the Service.
Service changes
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without liability to you. We will make reasonable efforts to notify users of significant service changes.
Termination
You may stop using the Service at any time. We may terminate or suspend your access immediately, without notice, for conduct that violates these Terms or that we determine is harmful to the Service, other users, or third parties.
Governing law
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maryland.
